The High Court yesterday cleared the way for the trial of dismissed RAB official Lt Col Zulfiqar Ali Majumder and six others in a case filed for looting Tk 2.07 crore from a shrine in Anwara upazila of Chittagong, reports UNB.
An HC bench comprising Justice SM Emdadul Haque and Justice SM Mujibur Rahman dismissed a petition filed for quashing the case proceedings and also vacated its earlier stay order on the case proceedings.
Mohammad Idris of Talsara Darbar Sharif filed the case with the local police station against 10 members of Rapid Action Battalion-7, two of their informants and some 15 unnamed persons on March 13, 2012 on charge of looting the money.
On November 4, 2011, Zulfiqar, commanding officer of the Rapid Action Battalion (RAB) unit and Flight Lt Mahmudul Hasan, along with 20-30 people, including some Rab men in plainclothes and their informants, allegedly looted the Talsara Darbar Sharif.
In the case statement, the complainant alleged that the RAB officials with the help of their cohorts entered the shrine and looted Tk 2.07 crore after breaking open the steel cupboard of the Darbar Sharif in the name of a search operation.
The money was given by the followers of the Darbar Sharif and kept in the cupboard.
Flight Lt Mahmudul Hasan filed a petition with the High Court for quashing the case proceedings.
On November 28, 2012, the High Court stayed the case proceedings and issued a rule. The final hearing on the writ was held yesterday.
Advocate Joynul Abedin stood for Mahmudul while Tajul Islam and Mohammad Enam argued for the Darbar Sharif.
