HC rule against expulsion of 15 PEC examinees

The High Court yesterday issued a rule asking the authorities concerned of the government to explain in two weeks why the section 11 of a circular issued by the Department of Primary Education dated December 20 in 2018 stating that a PEC examinee could be expelled for unfair means in the examination, should not be declared illegal.

The HC bench also asked the government to explain why the expulsion of 15 examinees of the PEC (primary education certificate) till November 19 should not be declared illegal and why the respondents should not be directed to take reexamination of those expelled examinees. The HC bench comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman issued the rule in a suo moto (voluntary move) after four Supreme Court lawyers brought the matter to the court’s attention.

Primary and Mass Education Secretary, Director General of Primary Education Department, Director General of National Primary Education Department and Chairman of Madrasa Education Board have been asked to reply to the rule within two weeks. The lawyers are: Advocate AM Jamiul Hoque, Barrister Farhad Reza, Advocate M Mahmudul Hasan and Advocate Md Faizullah.
