Delay in rape trials unacceptable

In recent times, violation of women, especially minors, has become so pervasive that there have been relentless calls from social awareness bodies plus law enforcers to carry out multi-faceted campaigns to trigger a public movement. Also, delay in trial is seen in most rape cases, resulting in either a sense of frustration among the victims or a fading away of the case itself.

 As per experts, the ratio of guilty verdict against offenders in rape cases remains extremely low with only 5 offenders getting punished against 1,283 rape cases resolved from 2011 to June 2018. According to a research of non-government organization Naripakkha, a total of 4,372 rape incidents took place in six districts of the country during the periods of 2011 to June in 2018.

 Out of them, a total of 1,283 cases have been disposed and only five offenders received punishment. The low conviction rates is due to influential position of perpetrators, lack of evidence, unwillingness of the rape victims to carry on with the process fearing social stigma and out of court monetary settlements to silence the victims’ family. Among these, the most popular is the last one where many women are given a financial compensation by the relatives of the alleged rapist. In such cases, the woman in question is also compelled to think about the prevailing social outlook which often blames the victim. In many cases, the woman is asked to hush up the crime at the pressure of her own family members on the belief that if details came out, the girl’s chance of marriage will be jeopardized.  The truth is that rape cases will see a rise in conviction when social perspectives change with victims not made to feel a sense of guilt. This can happen when the matter of sexuality along with the division between a healthy relation and a toxic one are discussed at the family and at schools. If a person is a victim of abuse then her relatives plus the local civil society must stand behind her to ensure justice.

The major flaw in a rape case is the tendency to obliquely blame the girl which often forces the victim to distance herself from seeking legal redress. The issue of molestation in many forms needs to be discussed with a social activism triggered all over the country. The main priority of the movement should be to assess facts first before pointing the finger at the victim. Campaigns are also needed to dissuade families of victims from seeking monetary solutions which allow rapists to go free.
