Man held for 10yrs despite presidential clemency

SC directs govt to free ex-school teacher

The Appellate Division of the Supreme Court (SC) directed the government to immediately release from jail Azmat Ali, a former school teacher from Pakhimara village under Sharishabari upazila, in Jamalpur. Azmat Ali had been arrested in 2009 even after getting presidential clemency in 1991 in connection with a murder case. The decision to send Azmat Ali to jail despite the presidential clemency was ‘unjustified’ and ‘unfortunate’, a six-member Appellate Division bench, headed by Chief Justice Syed Mahmud Hossain, said in the full text of the judgment released yesterday. On June 27, the same bench of the apex court had passed a short order following a review petition filed by Azmat Ali with the support of the Supreme Court Legal Aid Committee.

The review petition was filed with the SC against its verdict on August 11, 2010, which had scrapped a High Court (HC) judgment acquitting Azmat Ali of the charge of killing one Rezaul Karim in 1987. In the review petition, Azmat Ali informed the apex court about the President’s order granting him mercy and prayed for his release, according to sources in the Supreme Court Legal Aid Committee.

In the full text of the judgment, the SC said the review petitioner, Azmat Ali, son of Tazzat Ullah Sardar of Pakhimara village under Sharishabari upazila, had been convicted and sentenced to life imprisonment by the sessions judge’s court of Jamalpur on March 9, 1989, in connection with the case.

Following an appeal filed by Azmat Ali, the HC acquitted him on March 2, 2005. The state filed an appeal with the SC in 2008, challenging the HC verdict, and after hearing the state’s appeal, the Appellate Division, on February 20, 2008, scrapped the HC judgment and order.

Earlier, on August 21, 1996, Azmat Ali had been released from jail in view of the remission of sentence granted by the President on January 14, 1991.

But, after delivery of the Appellate Division’s judgment on February 20, 2008, he was again arrested on October 20, 2009. Since then, he has been languishing behind bars, the SC said in the full text of its verdict.

The SC’s office yesterday sent the verdict’s full text to the trial court concerned and the Jamalpur district jail to arrange Azmat Ali’s release.
