Tribunal sends ex-Sonagazi OC to jail rejecting bail plea

The Dhaka Cyber Crimes Tribunal yesterday rejected the bail plea of the former officer-in-charge (OC) of Sonagazi police station, Moazzem Hossain, and sent him to jail in connection with a case filed for recording Nusrat Jahan Rafi’s statement on video and leaking it online. Judge Mohammad As-Shams Jaglul Hossain passed the order in a jam-packed courtroom around 2.30 pm. He set June 30 as the date for framing charges in the case.

 

Moazzem, who was arrested from Dhaka’s Shabagh area yesterday, was brought to the court lockup around 12.30 pm before being produced in court around 2.25 pm.

During yesterday’s hearing, Supreme Court lawyer barrister Sayeedul Haque Sumon, who is also the petitioner in the case, told the tribunal that Moazzem did not show respect for the law

despite being himself being a policeman. After the tribunal had issued an arrest warrant against him, Moazzem should have appeared in court to submit a bail petition, Sumon said. “But he did not do so. Rather, he was absconding. It is a stigma for the police department,” he added.

The public prosecutor of the tribunal, advocate Nazrul Islam Shamin, appealed to the court to send Moazzem to reject his bail plea and send him to jail.

However, advocate Farul Ahmed, counsel for Moazzem, sought bail, claiming that the accused did not go into hiding.

“After seeing newspaper reports, Moazzem became aware that an arrest warrant was issued against him. Subsequently, he went to the High Court to seek bail. But, law enforcers arrested him without giving him any opportunity to appear in court,” the defence lawyer added.

He unsuccessfully appealed to the tribunal to grant bail to Moazzem.

According to the allegations, the former OC had summoned Nusrat after she filed a case against Sonagazi Islamia Senior Fazil Madrasa principal Sirajuddoula for sexual harassment on March 27.

The police officer quizzed her in his room in the absence of any lawyer or female cop and recorded the whole incident. He was seen scolding Nusrat and asking her indecent questions. Moazzem later posted the video on different social media sites.

Nusrat was set on fire on April 6 by Sirajuddoula’s stooges and she succumbed to her injuries at Dhaka Medical College Hospital on April 10.

On April 15, the petitioner filed the case with Bangladesh Cyber Tribunal under section 26, 29 and 31 of Digital Security Act (DSA).

Recording the testimony of the plaintiff, the tribunal judge had asked the deputy inspector general of Police Bureau of Investigation (PBI) to submit a probe report.

On May 26, PBI senior ASP Rima Sultana filed the report at the tribunal, stating that they found the allegations against the police officer to be true. A day later on May 27, the tribunal issued an arrest warrant against the disgraced cop.
