HC clears way for DNCC election

The High Court (HC) yesterday (Wednesday) paved the way for holding elections for the Dhaka North City Corporation (DNCC) mayor's post and polls in the new wards under the DNCC.

The HC lifted its earlier stay order on the election and discharged a rule issued in this regard that questioned the legality of the election schedule.

An HC bench, comprising Justice Gobinda Chandra Tagore and Justice Mohammad Ullah, withdrew its earlier order that kept the mayoral by-election withheld for six months.

Advocate Ahsan Habib Bhuiyan, counsel for petitioner Ataur Rahman, told reporters that the petitioner is unwilling to move with the petition. Hence, the HC bench rejected the petition that cleared the way for holding the election.

The Election Commission had fixed February 26, 2018 for holding by-polls for the DNCC mayor's post and elections for 18 councillor posts in the 18 new wards under the DNCC. The mayor’s post fell vacant after the death of Annisul Huq on November 30 last year. But the process of holding the election was halted after Ataur Rahman and Jahangir Alam, Union Council chairpersons of Bhatara and Beraid, filed the petition challenging the decision over their unions being added to Dhaka as city corporation wards.

Ataur and Jahangir are general secretaries of the Bhatara and Beraid units of the BNP and the Awami League, respectively.

After hearing their petition, an HC bench, comprising Justice Naima Haider and Justice Zafar Ahmed, stayed the mayoral by-polls and elections to 18 new wards in the city corporation for six months on January 17 last year.

It also issued a rule asking the government and the EC to explain why the schedule for holding the by-polls for the DNCC mayor’s post and elections in the new wards of the DNCC should not be declared illegal.
