Produce Awlad arrested on fake warrant

The High Court (HC) yesterday directed the jail authorities to produce Awlad Hossain, a programme officer of Gonoshasthaya Kendra, before it on January 15 next year.

Awlad is currently being detained in the Sherpur district jail after having moved four courts, following an alleged fake arrest warrant issued against him.

The HC also directed the Criminal Investigation Department (CID) to identify the culprits, if any, involved in the process of issuing the fake warrant against Awlad. An HC bench, comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman, came up with the orders after hearing on a writ petition filed by Shahnaj Parveen, wife of Awlad, seeking its directive in the matter.

The court also directed the chief judicial magistrate of Sherpur to grant Awlad’s bail prayer after examining necessary documents on whether this court had issued an arrest warrant against him or not.

It also asked the chief judicial magistrate of Sherpur to take initiatives for his release after checking whether other arrest warrants were issued against him beyond the Sherpur court’s warrant. According to the petition filed by Awald’s wife, Shahnaj Parveen, her husband had to move before the courts of Cox’s Bazar, Rajshahi, and Bagerhat seeking bail because of the alleged fake arrest warrant issued against him. Now, Awald is staying in Sherpur jail because of the same fake arrest warrant.

Advocate Zainul Abedin appeared in court on behalf of the writ petitioner, while deputy attorney general Amit Talukder stood for the state.

After the HC order, advocate Zainul Abedin said: “If the accused is released before January 15, he will come to the court himself. But if he can’t obtain bail before that date, the authorities will have produce him before the HC bench in line with its order.”

According to the case statement, the police arrested Awlad Hossain on October 30 from Ashulia area of Dhaka in a case filed in Nari O Shishu Tribunal No. 1 of Cox’s Bazar. His bail petition was rejected by a Dhaka court, which ordered that the case documents be sent to the Cox’s Bazar court. On November 13, the Nari O Shishu Tribunal of Cox’s Bazar said there was no accused named Awlad Hossain.

After receiving the Cox’s Bazar Court order, Dhaka Central Jail authorities said they had been asked to produce Awlad before a tribunal of Rajshahi as there was an arrest warrant against him.  But the Rajshahi court released him on November 24. Awlad was later produced in the court of Bagerhat and is now scheduled to be produced on December 16 in a Sherpur court. Since December 2, Awlad has been kept in the Sherpur district jail, said a lawyer.
