Order on Khaleda bail plea Sunday

The High Court yesterday fixed Sunday for passing necessary order on a bail petition filed by the BNP Chairperson Khaleda Zia challenging the lower court verdict that sentenced her five-year imprisonment in Zia Orphanage Trust graft case. The HC bench comprising Justice M Enayetur Rahim and Justice Shahidul Karim fixed the date after Khaleda’s lawyer Advocate Zainul Abedin prayed to it to pass an order on the bail petition.

Before fixing the date, the defence counsel Zainul told the court that this bench on February 22 ordered the trial court to send the case records to it in 15 days, which expired yesterday (March 7). When the court asked Zainul whether the case records have reached the HC, he replied that he does not know it.

Then, the HC bench fixed the date for passing necessary order on this issue. Later, Zainul, told reporters that they have mentioned the matter relating to Khaleda’s bail before the court in the morning. In response to a query, he said that the HC has the jurisdiction to pass an order on the bail petition of Khaleda even if the case records are not received by it.

Talking to this correspondent bench assistant of the special court, Mokarram Hossain, said, “The Special Judge Court-5 of Dhaka will send the records of the Zia Orphanage Trust graft case to the High Court by Sunday morning.

“We have completed all the proceedings to send the case records to the HC. But, we could not send it to the HC as the office time has ended. We will send it to the HC Sunday morning,” he added.

On February 22, the HC had accepted Khaleda’s appeal challenging the trial court verdict sentencing her to five years’ imprisonment in the graft case. The fine order against the BNP chief was later stayed.

Earlier on February 25, after hearing on Khaleda’s bail petition, the same bench of the HC kept its order pending until getting the records of the Zia Orphanage Trust graft case from the trial court. The HC had on February 22 asked the special trial court to submit all the case documents related to the verdict within 15 days.

On February 20, the BNP chairperson filed an appeal in the HC challenging her sentencing in the graft case. On February 8, Judge Md Akhtaruzzamn of the special court delivered the verdict in the graft case. Khaleda was sent to Old Central Jail with the conviction warrant after the verdict.

The trial court took over 11 days to provide the certified copies of the verdict to Khaleda on February 19. The BNP chief would have already been in jail for a month by the time the court sends the case dockets to the HC on March 8, according to court sources.
