In a landmark verdict, the Appellate Division of the Supreme Court (SC) yesterday turned down a government appeal filed against a High Court (HC) order that had declared illegal the Sixteenth Amendment to the Constitution, which had established Parliament's authority to remove Supreme Court judges for “incapacity” or “misbehaviour”. “By unanimous decision, the appeal is dismissed,” Chief Justice Surendra Kumar Sinha pronounced, as a seven-member Appellate Division bench unanimously upheld a previous HC judgment declaring the 16th Amendment to the Constitution illegal.
