Some DCs, OCs act like landlords, observes HC

Court denies bail to former Sonagazi OC

The High Court (HC) yesterday criticised some officers-in-charge (OCs) and deputy commissioners (DCs) by saying that some of the officials think they are landlords and act as they please. The High Court (HC) made the observation during hearing on a bail petition by former Sonagazi police station officer-in-charge (OC) Moazzem Hossain. The court also rejected the bail petition in the case filed under the Digital Security Act.

“Some officers-in-charge (OCs) and deputy commissioners (DCs) think they are landlords,” said the HC. Sonagazi Police Station’s former OC Moazzem Hossain has completely failed to protect the life of Madrasha student Nusrat Jahan Rafi and he damaged the

image of the police department, the court further said.

Advocate Ahasanullah, counsel for Moazzem, told the court that a video of Nusrat Jahan Rafi had been recorded on Moazzem’s phone, but it went viral on social media only after it fell into the hands of a journalist.

The HC bench then replied that Nusrat would not have been killed, if the video had gone in the hands of journalists earlier.  Advocate Ahasanullah told the HC bench, comprising Justice Md Moinul Islam Chowdhury and Justice Khizir Hayat, that the case filed against the police officer was a bailable offence. "Moazzem was seriously ill. He needed treatment. Hence, he should be granted bail," the OC’s counsel argued.

Opposing his prayer, attorney general Mahbubey Alam said that the allegations brought against the OC were sensitive.

If the police officer was indeed seriously

ill, there is a specialised hospital for his

treatment, he told the court.

The jail authorities would take steps for his treatment, if needed, the chief law officer pointed out.

 Later, the HC bench rejected the bail

petition, saying it had not been submitted properly.  The police officer had filed the bail petition on July 2.  He has been accused of unlawfully interrogating Feni madrasa girl Nusrat Jahan Rafi and recording the proceedings on phone. A video of the interrogation went viral on the social media.

Supreme Court lawyer Syeddul Haque Sumon filed a case against Moazzem under the Digital Security Act on April 15.  Moazzem was withdrawn and later suspended on May 10. A tribunal ordered his arrest on May 27 after investigators found the allegations leveled against him to be true. He was arrested on June 16 from Shahbagh in the capital.

 The next day, the Cyber Tribunal rejected his bail plea and sent him to jail.

 Earlier, Nusrat’s mother had filed a case with Sonagazi police over her daughter’s sexual harassment.  Moazzem had summoned Sonagazi Islamia Senior Fazil Madrasa’s principal Sirajuddoula and Nusrat, who accused the teacher of sexually harassing her.

The OC interrogated Nusrat in absence of her lawyer or any other woman and used inappropriate language.  The girl was set on fire on April 6 at her madrasa, reportedly by people loyal to Sirajuddoula. She died of burn injuries on April 10 at the Dhaka Medical College and Hospital.
