Why shouldn’t Khaleda bail be scrapped, asks court

A Dhaka court yesterday asked the lawyers of BNP chairperson Khaleda Zia to explain within October 7 why bail granted to the former prime minister in the Zia Charitable Trust graft case should not be cancelled. Judge Md Akhteruzzaman of the Special Judge’s Court-5 of Dhaka passed the order after Khaleda's lawyer submitted a petition seeking extension of her bail in the case. The court also asked the lawyers to submit their explanation on the rule by October 7. It fixed the same date for hearing arguments.

The court also said that if the lawyers fail to give an explanation by October 7, the court would pass its order on the prosecution petition that prayed to the court to fix a date for delivering its verdict

in the case. The court also asked the BNP lawyers to submit the higher court order on the BNP chief’s revision petition, in which she sought a stay order on the trial proceedings of the Zia Charitable Trust corruption case against her.

On September 27, the BNP chairperson filed a revision petition with the High Court (HC), seeking a stay on the trial proceedings of the Zia Charitable Trust corruption case against her. The BNP chief moved the HC challenging the legality of the lower court decision to continue the trial proceedings of the Zia Charitable Trust case in her absence.

On September 20, the court, set up inside the jailhouse, decided to continue the trial proceedings in the Zia Charitable Trust corruption case in the absence of the BNP chairperson.

On September 5, Khaleda appeared before the court but refused to appear before it for hearing any longer, citing her illness.

Previously, the trial was being held at a makeshift court in the Bakshibazar area. But on September 4, the law ministry issued a gazette notification, saying the trial in the graft case would be held at the Old Dhaka Central Jail on Nazimuddin Road.

On February 8, the same special court awarded Khaleda five years’ imprisonment in the Zia Orphanage Trust graft case. The BNP chief has been in jail since then.

The Anti-Corruption Commission (ACC) had lodged the Zia Charitable Trust graft case with Tejgaon police station in August 2011, accusing Khaleda and three others of abusing their power to raise funds for the trust from unknown sources.
