HC summons rly DG over failure 
to compensate Jihad’s family

The High Court yesterday summoned the Bangladesh Railway Director General to appear before it on August 14 and explain the failure to execute its earlier order that asked the Bangladesh Railway and Bangladesh Fire Service and Civil Defence to pay Tk 10 lakh each to the family of four-year-old Jihad, who died after falling into a deep shaft in Dhaka’s Shahjahanpur area in 2014. The HC bench comprising Justice Md Ashfaqul Islam and Justice Mohammad Ali passed the order after a hearing a contempt of court rule.

Barrister Abdul Halim stood for the petitioner while Advocate Asadul Haq represented the Bangladesh Railway. Earlier on March 1 last, the HC bench issued a contempt of court rule against the government for not complying with its order that asked the Bangladesh Railway and Bangladesh Fire Service and Civil Defence to pay Tk 10 lakh each to the family of four-year-old Jihad, who died after falling into a deep shaft in Dhaka’s Shahjahanpur area in 2014.

In the rule, the HC bench asked Bangladesh Railway Director General Md Amjad Hosain, Fire Service and Civil Defence DG Brigadier General Ali Ahmed Khan and its Director Major AKM Shakil Newaj to respond to reply to the rule within two weeks.

But, the respondent did not pay the money to the Jihad family till the date in line with the High Court order. Hence, the petitioner lawyer moved before the HC bench seeking its necessary order in this regard.

Earlier, on October 9 last year, the High Court released the full verdict of the case regarding the death of four-year-old Jihad asking the government authorities to pay compensation of Tk 20 lakh to his parents.

The verdict directed Bangladesh Railway and Bangladesh Fire Service and Civil Defence to pay Tk 10 lakh each within 90 days.

In its order the High Court state, “This order of awarding compensation will not impute /affect other liabilities, if there be any, of the respondent concern or each official resulting from the death of the said victim.’’

After a writ petition, the HC had delivered its short judgment on February 18 of 2016, which directed the respondents to pay compensation to Jihad’s family but the amount of compensation was not specified by the court. On December 26, 2014, Jihad fell into an unprotected well shaft while playing with other children in Shahjahanpur Railway Colony.

A group of volunteers pulled out his body the following day after government agencies called off their rescue bid claiming no body was inside the well. A High Court bench consisting of Justice Farah Mahbub and Justice Kazi Md Ejarul Haque Akondo sentenced four people, including three engineers of Bangladesh Railway, to 10 years’ rigorous imprisonment in the case on February 26.
