HC adjourns Khaleda bail hearing till today

The High Court (HC) yesterday (Wednesday) adjourned till today (Thursday) the hearing of petitions filed by BNP chairperson Khaleda Zia seeking bail in a case filed in Comilla against her on charges of vandalising vehicles in 2015.

After concluding yesterday’s proceedings, an HC bench, comprising Justice AKM Asaduzzaman and Justice JBM Hassan, adjourned the hearing.

Taking part in the hearing, advocate Khandaker Mahbub Hossain, counsel for the BNP chief, told the court that the name of Khaleda Zia was not included in the first information report (FIR). But her name was included in the charge-sheet with an ill motive to harass her politically, he added.

She has been suffering from various illnesses and is an old lady. So, the court should grant her bail on health grounds, Hossain said.

Opposing his submission, attorney general Mahbubey Alam told the court that the vandalism incident had taken place following the direction of Khaleda Zia. Eight people were killed and at least 20 injured when assailants hurled a petrol bomb at a bus in the Jagmohanpur area of Chouddagram in Comilla district during the BNP-led alliance’s protests on February 3, 2015.

Everything is clear following the submission of charge-sheet by the police on the incident. Specific allegations were made against Khaleda Zia and she cannot get bail  as the lower court is scheduled to hear her bail plea on June 7, the chief law officer of the state said.

As the official time ended, the HC bench adjourned the hearing.

After completing hearing in the vandalising case, the HC bench will also hold hearing on the other bail plea filed by the BNP chief in connection with the other case, filed by Raihan Faruki Imam in a Narail court on September 24, 2015, against her for making a statement about the number of freedom fighters and Bangabandhu Sheikh Mujibur Rahman.

Khaleda filed two bail petitions before the HC bench earlier, seeking bail in the cases as the government has shown Khaleda arrested in those cases.

Khaleda’s lawyers moved the Comilla district and sessions judge’s court for her bail in the two cases on April 23. The court set June 7 as the date for hearing the bail pleas. Khaleda’s lawyers then requested that the date be brought forward, but the proposal was rejected.

After that, the BNP chief filed a bail plea before the HC, challenging the lower court decision. The BNP chief sought bail from the HC in the case filed by Raihan Faruki Imam.

On December 21, 2015, Khaleda, at a meeting at the Institution of Engineers Bangladesh (IEB) in Dhaka, had said Sheikh Mujib did not want independence of the country, rather he wanted to be the prime minister of Pakistan.  A local court later issued an arrest warrant and later Khaleda Zia was shown arrested in the case.

On May 16, the Appellate Division of the Supreme Court (SC) upheld the HC order that had granted bail to Khaleda in the Zia Orphanage Trust graft case.

However, the BNP chief was not freed from jail as she was shown arrested in some other cases filed with different police stations in Comilla, Dhaka, Narail and Panchagarh. The BNP chairperson is now facing 36 cases.
