HC nixes bail forgery bid by ‘rapist’ of minor girl

The attempt of a rape accused to forge his bail went in vain following a cross-check of the bail order made by a lower court judge. Billal Bhuiyan (45) was accused of raping a 10-year-old girl at Sreepur in Gazipur.

Following a cross-examination of the matter, the High Court (HC) yesterday cancelled Billal’s bail and summoned the lobbyist, who had engaged a lawyer for his bail, to appear in court on May 27.

The HC bench of Justices Showkat Hossain and Nazrul Islam Talukder came up with the order after deputy attorney general Zahid Sarwar Kazal brought the matter to the court’s notice.

Kazal said the bail petition mentioned that lobbyist Rabiul Islam had engaged a lawyer named Jamal Uddin in the case. But the identification number (ID) in the petition mentioned the lawyer to be advocate Harun Ur Rashid.

Since there was no similarity between the lawyer’s name and the ID number, the court summoned the lobbyist in the case, he added.

According to the case history, Billal was charged with raping the minor at his Sreepur home. The girl fell sick after the incident and narrated her ordeal to her mother. The girl’s mother then filed a case against Billal and two others.

A medical test of the girl revealed that she was raped. However, Billal went into hiding after the incident.

Police submitted a charge-sheet against Billal and the other accused on November 17, 2017 before a lower court. The court was now recording witness statements in connection with the case.

Billal surrendered in the lower court on January 14 this year. The court rejected his bail plea and sent him to jail. Billal then moved the HC for bail on May 9.

In his bail plea, Billal misrepresented information on the case by claiming that the victim was 21 years old and he loved her. The accused further claimed that the girl’s mother had rejected his proposal to marry the girl. Billal also submitted a fake medical certificate in court to claim that he had not raped the girl.

On receiving the bail petition, the HC bench granted bail for Billal and sent it to the lower court hearing the case.

After getting a copy of the HC order, the lower court judge was astonished and informed the mattee to the deputy attorney general, who then informed the HC about the forgery. Finally, the HC yesterday withdrew its previous order and cancelled Billal’s bail and summoned the lobbyist in the case.
