‘Maintaining seniority in CJ appointment not constitutional obligation’

Law, Justice and Parliamentary Affairs Minister Anisul Huq yesterday said there is no obligation in the constitution to maintain seniority in appointing the chief justice, reports BSS. "It is clearly stated in Article 95 of the constitution that the President will appoint the chief justice. Nothing has been said (in the constitution) about maintaining seniority in the process. We respect the decision taken by the President," he said.

Anisul made these comments while talking to newsmen after addressing a workshop on human rights, sustainability reporting and responsible business conduct at a hotel in the capital. Organised by Bangladesh Employers' Federation (BEF), the workshop was presided over by BEF president Kamran T Rahman and addressed by International Organisation of Employers (IOE) Secretary General Linda Kromjong, National Human Rights Commission member and Daily Sun editor Enamul Hoque Chowdhury and Additional Secretary of Ministry of Labour and Employment Md Ashraf Shameem, among others.

While replying a question on the resignation of Justice Md Abdul Wahhab Miah, Anisul said, he can resign and it is his personal decision.

"You will see that appointment of judges at the High Court and the Appellate Division would take place very soon," the minister added. Commenting on BNP chairperson Begum Khaleda Zia's recent remark on the lower court, the law minister said whatever she said is false.
